What are my options?

I have worked for a small Medical Management firm for two years. I was notified last week that my employer was letting me go. No mention of termination and no documented cause. The CEO said the company wanted to move in another direction. It is a base salary plus commission position and they are paying me through the end of this month. I am still taking calls and transitioning my clients. 1. I have about 1,750,000 in potential sales still in my pipeline. Am I entitled to any of this? They have dropped the group health plan and will not offer me COBRA I am told. 2. I have two small children I provide health insurance for that suffer from a genetic bone disease. Am I screwed? I was looking for another job on an online web site and saw my position posted. With no documented performance issues, is this legal to just let me go with no severance, no insurance and no opportunity for commission I could have possibly earned.

Good morning,

I am sorry for the job termination. Unless you have a contract which requires severance, an employer has no legal obligation to provide any severance at all. As to termination, unless you have a contract on cause termination or other restrictions, they can terminate you at-will. They do not need to have performance or other cause reasons to terminate employment.

For COBRA, unless they are a covered employer (20 or more employees), they do not have to offer COBRA coverage.

As for commission, that depends entirely on your commission terms. You may or may not have a right to the commission. It is impossible to say without review of your agreements and their commission terms.

I would strongly advise that you contact an attorney to determine your rights on commission and other issues.
