Is a contractor responsible for a sub-contractor?

The contract is signed between me and the sub, but the only way the sub and I could have met was through the main contractor. The main contractor made himself ''visible'' to me, via the use of a ''job-contractor'' matching service, ServiceMagic.com

I got an e-mail on behalf of the contractor that they where interested, they then sent the sub. I have a signed letter from the contractor that acknowledges the fact that they use this sub-contractor.

The contractor and sub are father and son, they list the same business address and phone#.

The sub took half of the money, started the job and abandoned it 1/3 of the way through. My kitchen cabinets are ruined, verified by local cabinet salesman who sells the same cabinets that were ruined.

The cabinet frames have excessive stain, dried stain drip marks and it dripped on the walls and floor boards. The doors are drawers he took to his shop were abandoned on the driveway, I just happen to go outside and found them on the driveway.

The sub refuses to return any of my messages. The main contractor is basically saying talk to the sub, we have nothing to do with it.

I want to take legal action against the contractor and sub-contractor, are they both responsible?

You definitely have an issue here with both.merely introducing you to the sub is not enough, but if they in effect are really the same company (which you may well be able to prove), then you would have a claim against both.

Have a local attorney review your contracts with each, and do some research for you to determine how to proceed. Certainly, you can explore instituting suit against BOTH, and let them fight it out between them.
