Legal Question in Criminal Law in Colorado

Correction of Incorrectly Entered Court Records

In 1996 I was arrested for a 2nd degree felony in the state of Colorado. The judge amended the charge to 3rd degree assault and I was advised, on a technicality, to plead guilty. I was sentenced to one year of unsupervised probation and upon serving the sentence was to be granted a deferred sentence. My husband and I are trying to adopt and the background check came back with an arrest conviction. According to the paperwork I have, that plea of guilty should have been changed to ''dismissed with prejudice'' upon completion of sentence (which the records show occurred without incident). I called the courts, the agency that pressed the charges, and the county district attorney's office but they all refuse to update the record even though their own records indicate a dismissal with prejudice. How can I get this changed? The falsely listed conviction is holding up our adoption procedures.

Re: Correction of Incorrectly Entered Court Records

there are a few different things to do, but basically I could file a motion to correct the records - additionally, we could get a certified record from the court and we can file to have the record sealed. contact me if you want me to do these things -
