Legal Question in Criminal Law in Colorado

Long story short, I was robbed by some people I knew. I text mssgd them demanding my property returned. Mssgs went back and forth then they mssgd me they were "ON THEIR WAY to cut my n#%!s off!" I responded saying "Then I SHOULD put a bullet in their face." I filed theft report. When confronted they lied to cops but got caught lying. So they eventually admitted to robbing me. One was on probation when they robbed me, the other was out on bond. They showed selected text mssg from me (but not what was sent to me) Then I was arrested and now I'VE been charged with harassment for the above statement! They've been charged with petty theft, but I can prove they were threatening me! I only responded 4 min later. It was a stupid thing for me to say, but it was in response to their threats showing INTENT to hurt me. I simply stated an option. This is crazy! I have a clean record, no drugs, assaults or thefts. This is going to screw my life up! Why haven't they been charged with false info to police, or harassment too? Why hasn't bond been revoked or probation violated? My entire business was in the bag they stole to get my laptop. My laptop is gone, my business ruined, and all they got was a TICKET? This has already cost me THOUSANDS in lost business and equipment. This seems like malicious or at least selective prosecution by small town DA and cops. I have EVERYTHING CLEARLY documented! Help! Need advice!

It sounds like you have some strong potential defenses, often the police simply charge whatever they can and the District Attorney's are so swamped with cases to look at the facts objectively.

The first thing you should do is contact a criminal defense lawyer, this isn't the type of thing that you should just handle on your own, anymore than you should drill your own tooth and place a filling.

Long story short - hire a criminal defense attorney that has experience advocating for people charged in these situations. Mr. Berry is correct. There are a few defenses you might be able to file. Most criminal defense attorneys give free consultations.
