Legal Question in Criminal Law in Colorado

shoplifting

My finace' was charged and pled guilty to one count of shoplifting in 1991. Please advise how he should answer questions such as:

1. Have you ever been charged with a crime or misdemeanor?

2. Have you ever been convicted of a misdemeanor?

3. Have you ever been involved in and civil litigations?

Also, if a separate motor vehicle charge was dismissed, how would he answer those same questions? Please advise.

Re: shoplifting

1. He was both charged with and convicted of a crime. Whether a misdemeanor or felony depends upon the amount involved in the shoplifting.

2. This is not civil litigation - this is criminal litigation. Civil litigation results from something like a car wreck.

3. Charges which were dismissed are not convictions.
