Legal Question in DUI Law in Colorado

2nd dui

i have 2 dui charges in 6 months with no other criminal history ever. both dui's happened in CO . i am wondering if i will face mandatory jail time

You are facing mandatory jail of 5-10 days. Colorado requires jail on a second or subsequent offense. Depending on where your offenses occurred you may be allowed to serve any jail time as in home detention.

it is very possible to avoid any jail time, but would have to do some jail alternative like electronic monitoring. some jurisdictions do not allow this. you are looking at a 2y license revocation if you are convicted of both duis or dwais - you should get an attorney

It all depends. If you were on probation upon pleading or being found guilty at trial of either a DUI or DWAi then you could face probation revocation and thewn jail because of the second DUI/DWAI. Also it depends on how bad your driving was and the amount of your blood alcohol content (BAC).

There is a reasonably good possibility that you could face some time in county jail or work release or In home detention. It also depends in which county is your first and 2nd DUI
