Legal Question in DUI Law in Colorado

First DUI

I was arrested in April for a DUI. My BAC was .116 and I was pulled over for weaving. My police report says that everything as far as ''clues'' regarding DUI were normal such as eyes,speech,appearance. The odor of alcohol was the only thing listed as ''moderate''. I failed the field sobriety test as most do and so I was arrested. I was cooperative and polite to the officer. I have no priors, a good driving record(prior to this, am performing my community service and going to education classes right now. My court date is in September. I have already lost my license for 3 months with thee DMV but I am wondering what you think may happen to me in court. I am very scared.

It depends on the county and the judge. You should contact a DUI attorney that covers that county.

Sorry this is sort of a non-answer, but it can largely depend on which jurisdiction your case is in. In most, though, you would not be looking at jail, though that too can depend on certain factors (e.g. the BAC). Anyway, that's about the best I can say.
