First DWAI Charge & Clean Record

In El Paso County I wrecked my truck on I25 around 4am. Drove it to a parking lot and had my wife pick me up. Next morning (10am) State Patrol called from my truck, I met them there, completed roadside flawlessly and blew .06. Never formaly arrested me or read mirranda rights, but cuffed me and gave me a choice of blood test or breathalizer. I chose the latter and blew a .06 again. Charges were: DWAI, Failure to Report, Leaving the Scene & Careless Driving.

Can I get this lowered to a non-alcohol offense? What are the potential punishments and points on my license? Should I get a lawyer or see what they offer? Will my license be suspended?

The issue at your trial will be time of driving and alcohol. You could have been sober at the time of driving and gotten drunk since or you could have had alcohol in stomach (not blood stream) at time of driving under the limit.

the better defense will be drinking after driving -

the leaving the scene/failure to report is a 12 point offense and requires loss of license, so I would get a lawyer. I am willing to come down, but you might look up William Griffin in Colorado Springs as a good lawyer to hire.
