Legal Question in DUI Law in Colorado

If my husband in an alcohol related incident and blew a 0.38 here in the state of Colorado is there anything we might be able to do to fight it? He didn't hurt anyone or anything like that, but it is the second offense. He had multiple charges that were not accurate or true including driving without seat belts for him and his friend, following too closely (with no car in front of him), and failing to signal (although he did). So, is there anything we can do?
