left the state on a dui sentence

my brother was sentenced to community service but refused to do it after being sentenced for dui. he refused the breath test at the time so his liscence was suspended for 2 years in colorado. He tried to get a liscense in georgia but was denied. is there a statute of limitations on his crimes in colorado. he actually went back to colorado but could not wait on the court date. he had to get back to his job and could not afford to be away.Is there some paper work of form he can fill out to get the ball rolling is georgia and not have to go back to the state of colorado. it has been over five years and he still cannot get a liscence to drive to work.

Your brother will have to get a letter of clearance from Colorado before he can get the ball rolling in Georgia. I do not know Colorado license reinstatement laws so you will have to check with an attorney there. The following link might help: http://www.ncdd.com/statelist.asp?state=Colorado

The only statute of limitations is his death. The court already has jurisdiction over him, so it can keep the case open and keep a bench warrant out for his arrest as long as it wants. As long as there is a bench warrant for failure to appear in court, he will not be able to get a clearance letter from motor vehicle. Eventually the court may cancel the bench warrant, becuase the system does get bogged down with too many warrants. In my experience this happened in ten years in one case, fifteen in another. It may be possible for your brother to appear through an attorney without returning and resolve the matter that way.

Part of the clearance process in Co. will likely be the completion ofthe community service. You might ask if the service could be completed now in Georgia and vcerified throught the probation Dept.The other posts are right on target, so beyound that a Colorado attorney or Interstate 70 are the apparent options.
