Legal Question in DUI Law in Colorado

Question regarding the new DUI limit in Colorado

I'm writing to find out if the new bill to lower the DUI limit in Colorado to .08 will affect the DWAI limit? I ask because I know that in some other states where the DUI limit is also .08 they do have a DWAI. For Example, in New Mexico you are still legal to drive up to a .079. Only once you blow a .08 or above are you going to be in trouble.

In Colorado the DWAI limit is .05 (or at least was before this new bill).

Thank you,

Re: Question regarding the new DUI limit in Colorado

No, not as it is currently written, though it may be easier to get a non-alcohol plea bargain if you are DWAI.
