Legal Question in DUI Law in Colorado

Two Year Suspension

Is it a common practice in the state of Colorado, to suspend your driver�s license for two years for a Refusal to Take a Breath Test and a DUI? I have never received any tickets, arrests, and convictions in my driving career? The refusal was not intentional due to the fact that I was unaware of the consequences and felt it was my constitutional right to refuse. In my recent move to the state of Colorado the law for refusal and DUI was not included when I applied for my state license. No phamplets, books, guidelines, etc were presented or suggested at that time. I am well into my senior years and live on a budgeted income and can not afford the amount of money it costs to be able to complete the daily errands that are required to live a normal life. My first year of suspension is April 27th, then I have another year before I can apply for a regular license. During my first year I have been told I can apply for a red license. Enforcing a second year is highly unconstitutional. A recent situation happened recently in the county in which I live, involving a Judicial Judge who had a previous DUI, refused a breath test and was given another DUI. He was given his license back with no repercussions such as mine.

Apply for a probationary license for your second year.

Unfortunately, you lose your license for one year on the refusal and then an additional year for the DUI. You may be eligible for a proabtionary license after one year without a license. Hiring a competent DUI attorney would have helped your situation and may still be helpful
