Receiving gifts and Medicaid

My mother left me her house when she past. Her companion of 21 years lives in the house. That was our agreement that I do with it what he wants. He is 65 and on Medicaid, his health is not good. His daughter is now pushing the issue to have me put the house in his name. Would this be considered as a cash gift and have an effect on his Medicaid benefits? The equity in the house is quite large. She is telling him that Social Services said he could have it with no problem. Any information is greatly appreciated. Kim

Transferring the house to him would not affect his Medicaid, so long as he lives there. However, once the house is in his name, it will be subject to a Medicaid lien. There may be options that would save the equity in the house later on. You may want to speak to an Elder Law attorney about this.
