Visitation rights and responsibilitiesfollowing driver's licence suspension

My ex has had his driver's license suspended for non-payment. He lives in Colorado and I live in Nebraska. What are my rights and responsibilites for his visitations with our teenage boys who live with me? I know he has the right to visit with the boys, but do I have to let him take them out of the state since his license is suspended?

You should consider checking your separation agreement first to see if it has an easy solution for you - some documents specifically state that neither parent may drive the children without a valid driver's license and insurance.

If that's not explicitly stated in your agreement, you might consider requesting that your ex provide an alternative transportation while he's with the kids - for example, a friend who does have a valid license.

If possible, it's best to try to resolve this situation before your ex's parenting time before he drives out to meet you and the kids are expecting parenting time with Dad, only to see you and your ex in a big fight over his drivers' license.

Depending on the amount of child support that he owes you, you may also consider pursuing a contempt action against him, which can carry a jail sentence if he is found in contempt.
