Legal Question in Medical Leave in Colorado

Fmla/ mom

My mom was on Family medical leave for 6 weeks and when she went back to work, they cut her hours, so she is now working less then 35 hours a week, and she was working 40 hours before her leave. Is this legal, can they cut her hours? She has been with this company 12 years.

Under the requirements of the FMLA, the employee must be returned to the same position. This would include the same number of hours worked.

Your mother should consult with an experienced labor and employment attorney to advise her as to her rights. If you cannot find one in your area through lawguru, you might want to check out www.nela.org.
