Legal Question in Civil Litigation in Colorado

My father died on dec 5 07. My younger brother got my mom to sign power of attorney papers giving him the power to handle the insurance from my fathers death. I got her to sign a revocation of his power. Now that I have went through all of her account statements Ive found that he spent about 60,000 dollars on nothing that had to do with my mother. I tried to file a police report but no one will help. My mother is mentally ill and cant read or write. I feel helpless and dont know what to do. He should be held responsible for his actions. What can I do.

You should hire an attorney to investigate the facts, the power of attorney and these transactions and then determine if there is a basis for a suit to get that money back. The police cannot help because they consider this a civil issue instead of a criminal claim.

Contact an attorney as soon as possible as there is a statute of limitations on claims in addition to other concerns. Good luck.
