Legal Question in Civil Litigation in Colorado

I was away for two months and my apartment management office contacted me to let me know that a lot of my mail was misdelivered to another resident. They assured me they would hold it until I returned. When I returned, however, I learned all that mail was tossed in the trash by a maintenance person. I was told, via a message, that the other resident brought my mail to them in a trash bag. They never removed it from that trash bag, nor even bothered to label it, but kept it in the hallway with some boxes. Their negligence has exposed not only me, but also my elderly mother to identity theft because as her caregiver her mail comes to my address. The mounting stress is exacerbating debilitating conditions with which I already present.

I need to know if there is any legal remedy against them, as well as the Post Office.

Any claim based on negligence must also show damages. As far as I can tell the only damages are speculative in nature (pain and suffering). It is unlikely that you have a significant claim unless and until there is actual identify theft resulting in damages.
