Business Plan Duplication

About a year ago, I submitted a business plan to multiple prospective investors. Currently, the business is up and running. Today, I received a copy of a business plan from a brother of one of the investors I sent the plan to. The brother's business plan is my plan with a few minor changes, but otherwise a duplication of my business plan. The brother is now shopping this plan to investors.

On the cover of my B-Plan when I sent it states, ''This document is confidential and Proprietary. Photocopying or duplicating this document is strictly prohibited. This document may not be circulated or disclosed in whole or part without the consent of (my name)''

Am I protected and do I have any recourse for this blatent duplication of my business plan?
