Legal Question in Employment Law in Colorado

Refusal to see my own employee file

I was terminated and the letter stated, ''The reasons for this dismissal are documented in your employee file, sighting unprofessiona behavior, insubordiantion, and conflict of interest''. I disagree (obviously) with those statements and would like to see what is in my employee file but my boss said NO. I know CO is an ''at-will'' state and my boss did say when pressed for a reason that she did not have to have a reason. Can she legally keep me from looking in my employee file? thanks!

Re: Refusal to see my own employee file

Unfortunately, Colorado is not one of the many states that gives employees a right to see their personnel file. In 2005 the legislature passed a bill that would have required employee access but Governor Owens vetoed it.

You might try asking the human resources department of your former employer to arrange to let you see your file. If they refuse, the only way to see the contents of your personnel file would be through discovery in a lawsuit, assuming you had any legal claims you could bring in a lawsuit.
