Legal Question in Personal Injury in Colorado

Regulations of Colorado Law

I was in an accident 31/2 years ago in Colorado. I live in California. I have been going back and forth with attorneys and as of now I am on my own. I have sent a letter to the insurance co trying to settle this on my own. I received in the mail today a form from the court. It was a Order to Show Cause regarding rule 16. What is rule #16. Is this something I can take care of or should I try to find an attorney again. I just want this case over.

Although it is impossible to answer your question with certainty because I have not seen the document, in all likelihood you are being asked to comply with Rule 16 of the Colorado Rules of Civil Procedure setting forth procedures for "Case Management" of a trial. If you are pro se, it might be setting a date for a case management conference with the Judge and opposing counsel. According, I can only surmise that either you are being sued or have sued someone, and trial has already been set. You can find the Colorado Rules of Civil Procedure in a law library; you may be able to find it on the internet. You must determine what needs to be provided to the opposing side prior to trial. There are deadlines, and if you fail to comply you might be precluded from some of your witnesses and evidence. If you are unsure after reading the Rule and the document you received, you should seek legal counsel to avoid losing your rights. You should attend to this immediately as you probably are facing a deadline. If the matter is set for trial, as it would appear to be from the information you provided, you need to quickly decide whether you are going to represent yourself at trial. If not, you will need some lead time to find a new attorney and provide time for the new attorney to prepare.

Re: Regulations of Colorado Law

You definitely need to make every effort to hire a personal injury attorney in Colorado in the county where the accident took place. No one is going to know what Rule 16 is unless they are thoroughly knowledgeable with Colorado Civil Rules and Procedures and the Rules of Court in that state.

An Order to Show Cause is basically a court hering ordered by the judge to determine why something has not been done or why there is a delay. If you are unrepresented, it may very well be that you missed some type of deadline or time limit for filing certain papers. Good luck.
