Legal Question in Personal Injury in Colorado

My wife was injured in a car accident for which she was not responsible (the other driver's insurance has acknowledged this) while she was on an errand for her boss. Can we file a claim with worker's comp for medical bills and lost wages and also a claim with the other driver's insurance for personal injury (e.g.pain and suffering, other noncovered expenses)?

Thank you for your inquiry. Yes, generally your wife can file claims with both if she in fact qualifies for both benefits. However, the respective insurance companies will likely attempt to coordinate benefits so as to arguably prevent her for collecting twice for any specific element of damages claimed. This coordination process can become somewhat complicated and your wife will need to approach this with an awareness of her rights.
