Mandy was driving her car home one night, when a tyre punctured as a result of an invisible structural defect in its wall. She attempted to change the wheel, but with no success. Nick, a passing motorist, so her plight and offered his assistance. He changed the wheel but forgot to tighten the wheel nuts. As a result the wheel came of soon afterwards, the car crashed and Mandy was injured.

Advise her on any claim she may have in tort against Nick. Would your answer be different if nick were an Automobile Association patrolman, whom Mandy had summoned him to help her?
