Broken Lease Option to Own Contract plus much property damage.

This question is on behalf of my brother: My brother rented his home in Colorado Springs, Colorado with a contract that stated the rental was a least option to buy. $3,000 in earnest money was received. Contract was signed a year ago, tenant neglected to make rent payments and caused several thousand dollars in damage. The tenant has since been removed and the $3,000 has covered back rent but the damage is so extreme that repairs to fix all damages inside and outside the home have been estimated between $10,000 - $15,000 area (based on actual quotes from contractors). Insurance company refuses to pay for damages calling the damage vandalism. What recourse does my brother have to get back any of his money?

We recommend a no-cost initial consultation with our CO lawyer.

1. Do not take what the insco says at face value. They have a vested interest. Your brother's policy should be reviewed for applicable coverage.

2. If there is no coverage, then a civil lawsuit is the next step. This assumes the renter won't respond to ordinary demand letters.
