How to collect money from and evit a roommate

Our son and his friend signed a lease for an apt.,we

cosigned. Our sons friend is not paying his part of the rent. We would like to know the best way to collect back rent from him and also to get him out of the apt.

You have created a difficult situation for yourself. Since the friend remains on the lease, you cannot evict him from the apartment. Only the landlord could do that, and not so long as the rent is paid, and you are the ones who have agreed to pay it.

So long as you pay the rent and he is on the lease he can remain in the apartment. Of course if you quit paying the rent the landlord may evict both the friend and your son.

You may sue the friend for the money he owes, but the living arrangements could become a bit frosty.
