Legal Question in Real Estate Law in Colorado

A friend has lived, as an owner, in a condo for almost 15 years. She had an extra parking space 'grandfathered' in almost a decade ago. About 5 years ago she was told she had to pay to use her extra space and she has done so since. Recently a board member told her that they took away her extra space and to move her RV in two weeks or it would be sold. Can they do this?

It depends. Does she have anything in writing about it? What do the condo covenants say about parking spaces? Does anyone else have the same deal as her? It hurts her case that she has been paying (monthly?), as that sounds like rent and that she was leasing the space, in which case the owner could terminate the lease with proper notice. If the space is important to her, she should talk to an attorney, as I would need more facts to give you an answer to your question and would want to see the condo rules, determine who owns the space, why was the space taken, etc. Hope this helps.
