Legal Question in Real Estate Law in Colorado

No quit claim or survey

I live in Colorado. I bought land and built a house there 3 years ago. My husband noticed that there was no survey or quit claim documents. Our realtor notified the previous owner's agent. Now the previous owner is squatting on our property in a camper. Police and the realtors want nothing to do with this since the courthouse tells us both parties are owners. The man can show no proof of where his land actually is located, because there was no survey,etc Any advice? Thanks in advance.

You should have had title insurance and title should have been reviewed prior to closing.

You will need to contact an attorney and file to quiet title through the courts.

I know this is not what you want to hear, but you really need a lawyer. If you paid money for land and never received clear title, you may have valid claims against the seller and one or more realtors. Misrepresentations may have been made to you while you were considering the purchase. Your realtor may have breached his duty to you. You may also have to file suit to evict the previous owner if he is on your property. The longer you wait to deal with it, the worse you will be, I think, because there are statutes of limitations, and you don't want to leave yourself open to claims that you waited too long.
