Legal Question in Real Estate Law in Colorado

Real estate contract

We signed up with a realtor to purchase a new house that is to be built within the next 4-5 months. My question is - if we are not satisfied with the quality of service this realtor is providing, can we legally terminate this contract without risk of losing the deal with the builder/contractor of the house? Do we have the right to use a different realtor at this point?

Depends on the what you mean by signing up. Normally the seller has an agent that the seller is to pay for the services of selling the house. If the realtor is the seller's agent and you did not sign an agreement that the agent would represent you then you are not obligated to the realtor the seller is. You should then get another agent to represent you. However if you signed a contract with this realtor to help you find a house then your contract controls.

You may not be able to break the contract but you can contact the relator's broker, that is, the head person of the real estate office and complain to the broker. The broker is the one that is on the hook for the actions of the agents working under the broker's license. If the realtor is the broker then you can complain to the local real estate board and even to the state licensing authority.

I do not know CO law and these are general suggestions and should not be taken as definitive law. You should consult a local attorney that practices in real estate law.

Have you tried confronting the realtor about the lack of service? Or the builder if its the builders agent?
