Legal Question in Sexual Harassment in Colorado

Harrassed and Threatened

Do we have any ground against our Manager? We are gay and he made a pass at

us after ours, when we said no and distanced ourselves, he turned on us and

lied to District HR that we threatened him! District HR called a meeting and

refused to listen to us and the proof we presented but instead threatened us

with our jobs. 4 years perfect records from us and corporate backs this jerk up.

We have endured names like ''queers'' , ''lesbos'' and all things over the past year,

but this guy has totally destroyed us. Not to mention he has totally blackballed

us within the company. We have solid proof of what the guy did, phone

messages, etc. We need some guidance please

Title VII, the federal law that prohibits sexual harassment, holds employers liable, not individuals such as your manager. Whether you have a claim is unclear from the facts you gave in your question but to protect your rights, you would need to file a charge of discrimination with the Equal Employment Opportunity Commission within 300 days of an incident or file a charge with the Colorado Civil Rights Division within 180 days. You can file with either agency; you don't need to file with both.

You may have potential claims besides sexual harassment against your manager.
