Legal Question in Wills and Trusts in Colorado

Hello,

My brother recently passed away. He has a group life insurance policy through his employer, in Colorado, and did not assign any beneficiaries for this policy. The deceased has one surviving son (my nephew), in New Mexico. Can the surviving son give me a "Power of Attorney', so I can file the life insurance claim on his behalf, acting as the beneficiary? Unfortunately your brother's estate will require probate. Once appointed, the Personal Representative can pursue the insurance proceeds.
