brother's death

My brother recently comitted suicide. He lived with his girlfriend of 6 years. My mother is his legal guardian. Who has rights to his possessions? He had no will.

I am sorry for the loss.

If your brother died without a will, trust or mechanisms to avoid probate (such as joint tenancy, pay on death), then his assets will be distributed in probate under the intestacy statutes.

Unless the girlfriend claims rights as a common law spouse or other limited rights, she will not likely get anything under the statute.
