i was pulled over in my drive way charged for drinking and driving is this legal or not

The key to your question is "pulled over" which suggests that you drove into your driveway. Simply because you made it home does not mean that you were not driving while intoxicated to get there. You need a lawyer. There are programs available to avoid conviction under DUI.
