rent payment and security deposit

I have recently had my husband

arrested and he is no longer in the

house. Problem, his pay check paid

the rent,which is now higher. Can I

have the landlord take out 1 months

rent from the security deposit and

not get evicted? This is an

emergency situation. I just want to

know what I can do. FYI I don't have

ANY money right at this time and my

family can't help.

You can certainly ask the landlord to do that and explain your situation, however, he is not legally obligated to take your security deposit in lieu of rent. I'm sure he will also want to know how you will pay next month's rent and your rent going forward because it does not sound like you can afford your apt. w/o your hsuband's paycheck.
