Legal Question in Bankruptcy in Connecticut

filing for bankruptcy

In February of 2000, I asked my lawyer to file for bankruptcy in the state of Connecticut. As of this date, April 25th, 2000, there is still no record in the Hartford court that he ever did. When I talk to my lawyer, he say's that everything has been mailed and that it takes time. I feel as though the court should have some record of filing by now. I am very upset and very nervous. Please Help!! I feel my lawyer is inadaquate and I need some answers Thank You for your interest!

It certainly does not take this much time. Your attorney should have requested the court to provide a date stamped copy of the petition showing the date it was filed and your docket number. Call your attorney. If he has neither confirmation of the filing nor the docket number by this time then the court has not received the petition. Follow-up with the court itself. Either the petition was lost in the mail or your attorney did not send it and is lying to you. If, at this point, the attorney has not received confirmation of the filing he should be very aware that the mailing has been lost. He should immediately offer to prepare and have you sign a new set of papers. Insist that he file this set by overnight mail and offer to pay the extra mailing cost. If he does not cooperate ask for your money back, report him to the local Bar oversight agency, and get a new bankruptcy attorney.
