Used Car Dealer Fails to Deliver the Car

On 7/16/09 I agreed to purchase a used car form a local car dealership for $1,700. We signed the contract and I paid $200 deposit. The car was to be delivered on 7/24. On July 20 the dealer called to say that the car had been sold to someone else. He said he forgot that he had a contract with the other party. My deposit has not be returned. What action can I take?agains the dealeship?

While I agree with Attorney Subbloie, you also have claims for fraud, Connecticut Unfair Trade Practices Act, Quantum Meruit, unjust enrichment in the alternative, negligence, wrecklessness, fraudulent misrepresentation. Also you may have Federal claims if the car was financed - The Truth in Lending Act would cover this. You can sue the dealer for breach of contract and the return of your deposit. Small claims court is your best venue.
