Legal Question in Consumer Law in Connecticut

Home Improvement Contract

I have a contract with a licensed home improvement contractor to repair some water damage in my basement. I gave him a large deposit and he came 1 day, did some prep work and then disappeared for almost 2 months. The contract stated the work would be done by 6/30 and it's now August. He finally came back, did some of the work and is now looking for his next installment. I am holding off as I don't feel he has done work equal to the deposit I gave him and if I give him more money he will disappear again. He is trying to tell me that I am now the one violated the contract. Am I within my rights to withhold payment until the job is complete?

Re: Home Improvement Contract

You cannot withhold payment. Under the contract, you have a duty to pay and the contractor has a duty to perform work. Simply because he fails to perform his duties, does not suspend your duties. You would have to sue him for the damages he has caused by the breach of contract. If you need further help, you can email me at [email protected].
