Legal Question in DUI Law in Connecticut

Was caught diving under suspension.

4 Days ago i had to be at an orientation For the college that i will be attending in a couple of days As a full time student. It was mandatory that i attend the orientation. My drivers licinse is suspended until january, 2009. My license was suspended for a dui conviction about a year ago. I was placed on probation for 18 months. I had no one to give me a ride that day. So i had to take that chance and get to school on my own. Police officer stopped me for not wearing my seat belt don't get me wrong i wear my seatbelt all the time i was nervouse being out on the road to begin with. I was less than 5 minutes away from my school. I also i have proof of where i had to be. I immediately contacted my probation officer and told her what happened. My question is am i in violation. I'm a single mother of 3 children. I'm afraid of facing jail time never been there i don't have a criminal record. I'm the only person who supports my children. And if that means going to jail because i had to chance it to go to my school orientation. I'm afraid of losing everything. What should i do?

Re: Was caught diving under suspension.

Unfortunately, you are facing a mandatory 30 day jail sentence for driving while your license is under suspension for dwi.

For you to avoid serving jail time, a judge has to find mitigating circumstances, that is, a very good reason to excuse you for driving. The law even requires the judge to state in writing why a jail sentence should not be imposed.

You definitely should have an attorney help you with this situation. You may call me (office 860.236.9350, cell 860.977.0660) for assistance.
