401k in divorce

Dear Sir/Madam,

In my pre-marriage agreement my husband agreed I and his ex-son are beneficiaries of his 401k. However,

after we married he never added my name as beneficiary of his 401k plan. Now we plan to get divorce.

Can I claim half of his 401k (since eather i and his ex-son has half benefit of his 401k )
