Arrest for not appearing at deposition

I am involved in the early stages of a divorce. A deposition was scheduled with my former attorney who has resigned from the case. I contacted wife's attorney to advise her that I would not attend the deposition because I was without counsel and also that I had just started new employment and couldn't possibly take the time off. Her lawyer refused to postpone the depo and in fact told me that she could have me arrested if I failed to show. This is NOT a court ordered deposition. I do not believe she can do this. I need to know for sure that I can refuse without jeopardy.

You need to file a motion for continuance with the court to get a court order to postpone the deposition. Hopefully, you have time to do this. If time is runnng out then go to the clerk's office and speak to the family clerk in charge. Tell him or her what you want to do. They will assist you although they can NOT give you legal advice.
