Divorce and Visitation

Do my two daughters (ages 10 and

14) have to go with their father even

if he is being abusive to them

(swearing, screaming, threatening)?

He is very unstable and has had

different women moving in and out

with him that my children have

grown attached to. This is a very

unhealthy environment. What can I

do? They live with me and see their

dad one night a week and every

other weekend (as specified in our

divorce decree). Thank you for you

help.

You would need to seek a modification of the order of visitation based upon the change of circumsmtances and the interests of your children. If you can establish that the father is in fact abusive and a threat or harmful to your children you may be awarded supervised visitation. It is unlikely that the father would be precluded altogether from visiting with his children. However the circumstances may require a limitation on his visitation, or that it be supervised.
