my wife and i have been living separetly for about three years (i found out she was cheating)we have not been able to work things out .she got pregnant and hid it from me for 8 months ive been seeing my kids and been helping out financially and or buying groceries .i would like to buy a home for myself now and am wondering if she would be able to take the home i havent bought yet and make me leave if we go thru the court process

She would not be able to take the home and make you move out, but if you put down, say, $20,000 on the new home she could claim that the $20,000 was half hers, as it was a "marital asset". If this marriage isn't going to last, you're much better off ending it now. Usually, assets acquired during the marriage (not assets acquired DURING THE TIME YOU WERE MARRIED AND LIVING TOGETHER) are split 50-50. So if you let 5 years go by before starting a divorce, she can claim half of what you acquired during those 5 years, even if you weren't living together. Thers's no upside, and a lot of downside, to remaining married.
