Unauthorized Reference Check

I have reason to believe that a prospective employer with

whom I was interviewing contacted an individual who previously worked for me, in order to get a reference. Since I had had to counsel and discipline this person in the past, he said negative things, and the prospective

employer is no longer considering me. I was not asked

nor informed of any reference check, I signed NOTHING

authorizing one, and I was not told directly of the

feedback so that I could refute the information. Can I

bring action against the prospective employer and/or

against the person who gave negative information?
