roommate eviction

i have a roommate who we have asked to leave. he was given 2.5 mos. notice. My name is the only name on the lease, which was signed over 5 years ago. He is refusing to leave and claims that he does not have to because he established legal residency, although his car is not registered to the house address and his license is also not at the present address. what do i have to do to get him leave?

To begin with, yiu would need to serve him with a Notice to Quit listing the reason as "no longer has the reight to occupy." If he did not leave by the quit date, you would then procede to the eviction lawsuit.

In any case, I would strongly reccommend you find a lawyer to do this. Housing Court law is frought with technicalities and the smallest error can set you back considerably.
