Legal Question in Military Law in Connecticut

Re-Entry Code/Discharge upgrade

In 2000 I went awol from my unit in boot camp. I was gone for 4 1/2 months and turned myself in knowing it was the right thing to do. I ended up at Fort Knox, where I was offered a discharge, or to return to my unit. I chose the discharge for 2 reasons. 1) I saw another recruit get beaten by other ppl in our platoon for refusing to train, going awol surely would get me the same as I would be sent to my unit and not another. 2) We were told could upgrade our discharge and it would be done so automatically after 6 months. Well now I'm in confused because answers ive recieved have been mixed depending on the website as to the possibilty of actually obtaining an upgrade. Any proffesional legal advice would be greatly appreciated, as I've now been told to consult and hire an attorney if I want to get anywere.

Re: Re-Entry Code/Discharge upgrade

1. There is NO such thing as an automatic upgrade AT ALL.

2. You can apply for upgrade anytime from the date of discharge and for up to 15 years after. However, there's no guarantee of an upgrade.

3. Yes, we do upgrade cases.
