Legal Question in Medical Malpractice in Delaware

Partial loss of lung

My fiancee is incarcerated, he advised the correctional facility and medical dept that he had shortness of breath and trouble breathing for 2 weeks. They assumed heartburn and treated him for that. Finally, they transported him to a hospital and found out that he had a collapsed lung and had to remove part of his lung. I want to know if he has a medical malpractice case. We've contacted several lawyers but to no avail. If he wasn't incarcerated, then we would have a case but since he isn't, then it seems that he has no rights. Thank you

In MD, you have a very limited time to place a governmental entity on detailed Notice of a TORT CLAIM. In some cases, this is as little as 180 days. If you are not too late, and you provide me with the complete medical records, I will submit it to an expert to see if there was any breach of the standard of carem i.e. malpractice.
