Legal Question in Disability Law in District of Columbia

Diagnozed ADA disability

My FMLA Leave will expire on Monday, 11/10. I am due to

return to my job, but both my

medical doctor's have recommended

that I ask for ADA protection and

a lateral transfer. On 10/23, I submitted an email request for

ADA protection and a written request to be transferred with

the employer system (education).

My psychiatric doctor wrote a detailed report to the EEOC Office

of the Employer indicating that I

am under his care and that I should

be given a transfer and reasonable

accommodations. The EEOC office

has denied ADA protection as well

as my request for reasonable

accommodations. If I do not return

to the same job on Monday I will

be fired. What are my options?

Correction to previous answer: I meant to say file your appeal of the EEOC decision that ruled you ineligible for protection under the ADA.
