Are there any laws governing who owns corporate documents, the corporation or the employees who create them?

Specific situation: an employee terminates and takes a copy of all emails and files; have any laws been broken?

More specific situation: in the course of downloading the emails and files the employee deleted them from the network (backups enabled all material to be restored); now have any laws been broken?

There is no written corporate policy at this organization covering this situation, nor are any employees asked to sign any waivers or disclaimers at any time.

I would doubt that any laws have been broken with respect to the situation described. A more important consideration, however, might focus on whether any of the emails and files which were taken were subsequently misused and as a result individuals and or the the corporation itself provably damaged.
