Failure to Treat or Diagnose

Is legal action available for failure to treat or misdiagnose if the time period only involves about 2 or 3 weeks?

Nov. 2007 my brother went to hospital in Wash., DC for trouble swallowing and the diagnosis was an abscess. Although a CT scan was taken, because he had a Dr. appt in New York in Dec. 2007, it was decided only to treat abscess. In Dec. 2007 he went to the hospital in NY and was diagnosed with tongue cancer.

A failure to administer the proper standard of care

then prevailing in a particular community to a particular patient could happen quite as easily within a two or week period as it might within two or three months or even two or three years. What counts is the relevant facts concerning the treatment that was actually given by the medical provider and whether it was substantially substandard when compared to that which prevailed it the comminity at the time it was provided to the patient in question.
