Legal Question in Civil Litigation in Dominican Republic

Attempted Rape in Dominican Republic Hotel

While on a family vacation in La Romana, Dominican Republic at a Sunscape Resort. My wife was in our room by herself. While in the shower a man opened the curtain and directed her to leave the shower quietly. Confused she followed his request. He directed her to the bed and had her sit and pushed his head to her vagina. She pushed him away and was able to convince him that the kids were in the hallway causing him to flee out a balcony door. He was never caught and from shock she could not recall any identifying features except that he was black and was clean shaven, which would account for a majority of Dominican Republic males. She could not recall what he was wearing so it is uncertain if he was an employee of the hotel or a visitor, or neither. The management was informed, who then informed the police. They said we could press charges but then would have to stay in the Dominican Republic till the end of the investigation. We could not stay since our kids had to get back to the US to school and we had pets and a household to maintain. The hotel said we would have to sign a paper stateing that we do not hold them responsible which she signed but later regret it. Do we have any kind of case against the hotel or travel agent

Re: Attempted Rape in Dominican Republic Hotel

You may have a cause of action against the Hotel. However, If this is a local hotel, you need to sue in Dominican Republic. If this is a chain hotel, then there might be a possibility to sue in USA

(If the chain is the U.S. chain).
