non-promotion due to ''health '' problems

I recently applied for a promotion with the company i have worked for for 21 years. I have been diagnosed with fibronyalgia and possibly sleep apnea, but still manage to complete my job duties. When told i was not promoted I was told i qualified and that with minimal taining would be able to do thejob, but that personal problems came up as a negative comment by a supervisor.When I said i didn't have any personal problems, my supervisor mentioned my ''health'' and that the job in question required certain hours which are very close to the hours that i now maintain.Occasionally I do need to leave work early due to the pain and fatigue,or for a doctor's appt but always with my immmediate supervisor's permission or knowledge. Do I have any recourse for the negative impact of this verbal comment?

Youhave the right to make a complaint to the EOC (Federal) and/or to the Florida Human Relations Commisions. An administrative complaint is usually required before a law suit may be filed. Good Luck.
