Mental defect defense

I have a case in front of an administrative law judge. I was arrested, was not convicted, charges dropped. But they are attempting to take my professional license for the charges I was arrest for. I was under the influence of mental health meds that had a negative effect, can I seek protection under F.S. 775.027 since the prosecution is not a criminal prosecution?

An attorney would need to evaluate the Florida Statutes in addition to the annotated caselaw in order to give you a qualified answer. Also, without access to your criminal matter, any advice would be premature and likely incorrect. When you are dealing with professional licenses, it is not worth it to try and handle these matters on your own. Just my opinion! You're dealing with your livelihood. Plus, I've seen simple administrative matters turn into another civil or criminal case!
